Is this a passport renewal or a re-issue with change in personal particulars?

It is a re-issue, and the distinction matters. VFS Global's guide: if any particulars are changing, select "Change in Existing Personal Particulars" plus the appropriate "Passport Re-issue Reason," and attach the checklist documents. CGI San Francisco's FAQ answers the marriage question directly: you apply for a "Re-issue" through VFS Global.

The most common self-inflicted failure is selecting only "validity expired" because the booklet is also near expiry; a wrongly categorized packet gets returned, costing weeks. Check the personal-particulars option even if your passport is also expiring. And every detail printed on your current passport (name, date of birth, place of birth, parents' names, spouse name) must be entered exactly as it appears today; mismatches put applications on hold.

Which documents prove the name change: marriage certificate, joint declaration, or affidavit?

For a woman changing her surname after marriage, the May 2026 VFS checklist asks for one of two proofs:

  • A copy of your marriage certificate, or
  • A duly notarized Joint Photo Declaration signed by both husband and wife.

A divorce decree is needed only when the change is divorce-based. On top of that proof, VFS lists a notarized Affidavit of Name Change as mandatory: its own deed-poll-style form stating both names, signed before a notary public or a consular officer, with a valid notary commission expiry date and no hand corrections.

Also note what is absent: a spouse passport copy appears nowhere in the marriage name-change section, and no joint photos are required beyond the one on the joint declaration.

VFS's own paperwork holds one genuine contradiction: the affidavit's disclaimer says no proof of marriage is required for a woman changing her surname after marriage, while the checklist requires the certificate or joint declaration. Include both.

Which annexure is the joint photo declaration: D, E, J, or K?

Four letters circulate because the government reshuffled its annexure list. Current lettering on passportindia.gov.in, checked July 2026:

  • Annexure J, the "Joint Declaration in lieu of Marriage Certificate," is the joint photo declaration you are looking for.
  • Annexure D is now a parent or guardian declaration for minor passports; guides citing it for marriage are using obsolete lettering.
  • Annexure E is a separate plain-paper self-declaration of citizenship and clean record that every adult re-issue applicant in the USA signs, name change or not.
  • Annexure K for this purpose does not exist on the current official list.

The VFS checklist itself uses no letter; it just says "Joint Photo Declaration."

Does a US marriage certificate work, and does it need an apostille?

Use the official county or state certificate from the registrar or clerk, not the ceremonial keepsake. The VFS checklist asks only for a "Marriage Certificate Copy" and states no apostille requirement for it.

The apostille rules blogs generalize are narrow: consulate pages require attestation or apostille only when the spouse is a foreign citizen and the certificate was issued by a foreign government, or for foreign divorce decrees. If both spouses are Indian citizens and you married at a US courthouse, no official page we reviewed requires an apostille. Consulates do reserve the right to ask for more, so when in doubt, email yours first.

Do I need newspaper ads or a Gazette of India notification?

For the passport re-issue itself, no. The current VFS checklist applies newspaper advertisements only "in circumstances (other than marriage, remarriage, or divorce)." Those other changes require ads in a national daily in India and one in the USA (or a state Gazette notification), plus at least two public or school documents already in the new name. The two-ads instruction still circulating comes from older outsourcing-era guides; ignore it for a marriage-based change.

Downstream Indian records are a separate question. The re-issued passport in your married name becomes the primary proof for updating Aadhaar, PAN, Indian bank accounts, and property records. No central rule we reviewed requires a Gazette filing for a marriage-based change, but individual banks and sub-registrars set their own document lists; keep the notarized name-change affidavit as backup before paying for a Gazette notification.

Can I add my maiden name as a middle name at the same time?

CGI New York treats "change in name due to marriage" as its own category, distinct from a "major change in name." Its example: Ritu becoming Ritu Thakur is the marriage category if due to marriage; a change not due to marriage is a major change.

Restructuring your given name at the same time (say, First plus Maiden-as-middle plus Spouse's surname) is not addressed on any official page we reviewed. The risk: the consulate treats it as a non-marriage change, triggering the newspaper ads plus two public documents in a name that exists nowhere yet. For anything beyond a straight surname swap, ask your consulate in writing before you file.

Will the name change trigger police verification, and how long does it take?

The official language is conditional: consulates re-issue without fresh police verification "provided there is no change in personal particulars" and the previous police report was clear. A name change is such a change, so it can send your case for fresh verification at your Indian address; no official page makes it automatic. On timelines: VFS quotes about 3 weeks once the application reaches the consulate, excluding VFS handling and mail time. If the police record is unclear or the case is complex ("a major name change" is on VFS's list), expect approximately 30 days or more. How much does the name-change re-issue cost in 2026?

What else goes in the packet, and what gets applications returned?

Beyond the name-change proofs, every adult re-issue from the USA requires:

  • The government online form (the new GPSP 2.0 Passport Seva portal) with an ICAO-compliant photo (color, 630 x 810 pixels, white background), your scanned signature, and all supporting documents uploaded; without these uploads the application is not accepted.
  • 2 identical printed photos for the paper forms, on a white background, taken within 6 months. VFS USA accepts either 51 mm x 51 mm (2 x 2 inch) or 35 x 45 mm prints. Note the online portal is different: it wants a 35 x 45 mm digital file (630 x 810 pixels) and rejects a square 2 x 2 inch upload.
  • Your current original passport, plus copies of the first and last pages.
  • The Affidavit for Change in Appearance and Signature, mandatory for all applicants even when nothing changed (indicate that nothing has changed, affix one printed photo, sign, and notarize).
  • Annexure E, the plain-paper self-declaration, signed in original.
  • A notarized color copy of your valid US status (green card front and back, visa, EAD, or I-797A).
  • A color copy of US address proof matching the application and your return shipping label.

Submit by mail or in person by appointment at one of VFS's 17+ Indian Consular Application Centres (New York, Chicago, San Francisco, Houston and more). Mail rules are zero-tolerance: one application per envelope, the return address must match your address proof, and jurisdiction follows your state of residence (a California applicant files under San Francisco). If you or your spouse carry an OCI card, the marriage name change follows a stricter rule: the Embassy of India in Washington DC lists "change in name for whatever reasons, including change in name after marriage" among the triggers for OCI re-issue. The physical re-issue is filed under OCI Miscellaneous services; fees via VFS are $25 + $3 ICWF + $19 VFS, or $47 total.

NRI forums misquote this constantly because the opposite is true after a plain renewal with no name change: only a free online update of passport details is needed, within 3 months of receiving the new passport (later than that, it becomes a $47 paid service with a quoted 8 to 12 week turnaround, per VFS's June 25, 2026 notice). For most adult cardholders the dividing line is the name: same name, free online update; changed name, physical re-issue. A few exceptions force a re-issue regardless: the first new passport after age 20 if the OCI was acquired before 20, a change of nationality, a lost or damaged card, and errors in the card. Can I travel or get visa stamping while my visa and I-797 still show my maiden name?

The consensus practice: documents follow the passport. Book tickets and fill visa forms in the current passport name and let older records catch up. No official page we reviewed covers this mismatch, so treat this as widely reported practice, not government guidance.

For stamping or dropbox with an I-797 still in your maiden name: complete the DS-160 in your new name exactly as printed in the re-issued passport, disclose the maiden name under previous names, and carry the marriage certificate and name-change affidavit (plus the old passport if you have it). Consulates issue the visa in the passport name; the petition typically catches up at the next extension or amendment.

For flights, book in the current passport name, always. Airlines can refuse boarding when the ticket, passport, and visa stamp do not line up. Avoid international travel mid-cascade if you can; if you must fly, carry the marriage certificate, the affidavit, and the prior-name documents. And during the re-issue itself your original passport sits with VFS, a window with no travel at all.

In what order should I update my US documents afterward?

The sequence that works: Indian passport first, then Social Security, then the driver's license, with immigration filings catching up at the next extension or amendment. Agencies want an identity document already in the new name, which is why the passport goes first.

Social Security has the one clean official answer: request a replacement Social Security card, online in most cases; it arrives by mail in 5 to 10 business days. Office practice varies: many accept the new-name Indian passport plus marriage certificate, some want a US immigration document in the new name, and filers who hit that wall generally report succeeding at another office rather than waiting for an H1B amendment.

For visa stamps, I-797 notices, and green cards, procedures live on uscis.gov and travel.state.gov and change often; confirm your case with an immigration attorney. Until every record matches, keep the previous-name documents, marriage certificate, and affidavit together.

Should I change my name on my Indian passport at all?

No official checklist or consulate page we reviewed requires it. The costs: a $146 re-issue with no Tatkaal option, possible police verification in India, a mandatory OCI re-issue if you hold one, then SSA, DMV, immigration records, and banks in two countries. Against that, permanently mismatched spouse names create friction in a spouse's OCI application and in children's paperwork. Neither answer is wrong; drifting into it one document at a time is. Decide once, then run the sequence deliberately.

Do both spouses need to update their passports?

No. Adding a spouse's name is its own category on the same checklist, with the same proofs; nothing on the current checklist requires the other spouse to file anything.

Why do I need the Affidavit for Change in Appearance and Signature when only my name changed?

VFS made it mandatory for all adult re-issue applicants. Indicate that nothing has changed, affix one printed photo, sign, and notarize.

Do I have to list my maiden name on the DS-160?
